Reckless Driving

Reckless driving is one of the more serious offenses that can be found in the Vehicle and Traffic Law. The essence of the offense, is that the driver unreasonably interferes with the use of the highway by others or unreasonably endangers users of the highway.

Upon conviction, the penalties aer as follows: the imposition of five points against your license, and although no mandatory suspension or revokation of a driver's license is called for, it can be the subject of a permissive suspension or revocation. There is a mandatory suspension, if the crime is committed in the six month probationary period that follows licensing. In addition, the maximum sentence of this misdemeanor is thirty days in jail and a substantial fine.

Specific conduct whic has been held to constitute reckless driving includes:

  1. Driving on the wrong side of the center lane;
  2. Running a police barricade with flashing red lights to warn motorists;
  3. Zigzagging from one side of the street to another;
  4. Pulling out from behind a trailer stopped at a stop sign into a lane of oncoming traffic;
  5. Proof that the motorist fell sleepy and then drove off the road at 40 to 45 miles per hour;
  6. Falling asleep at the wheel;
  7. Failure of a motorist to yield the right of way to a police vehicle, when required to do so; and
  8. Driving on the sidewalk which by definition is part of a highway.

However mere proof of an excessive speed without more is usually not reckless driving.
